4. Vote to elect whether to disclose any or all discussion held in closed session (San Francisco Administrative Code Section 67.12(a)) (ACTION ITEM)

5. Public Comment

(Members of the public may address the Police Commission for a time period determined by the Chair on items that are within the subject matter jurisdiction of the Commission but do not appear on the agenda. Speakers shall address their remarks to the Commission as a whole and not to individual Commissioners or Department personnel. Under Police Commission Rules of Order, during Public Comment, Commissioners are not to enter into debate or discussion with speakers.)

8. Discussion and possible action to grant or deny Motion for Dismissal of Disciplinary Charges filed in Case Nos. C06-186 JCT and C06-187 JCT under Government Code 3304(d)

(ACTION ITEM)

The following time limits will apply:

Charged officers' opening argument: up to ten (10) minutes

Department's opening argument: up to ten (10) minutes

Charged officers' closing argument: up to five (5) minutes

The Commission may decide to consider Item #8 in whole or in part in Closed Session pursuant to Government Code sections 54957(b), and S.F. Administrative Code sections 67.10(b), in which case:

a. Public Comment on all matters pertaining to the Closed Session

b. Vote on whether to convene to Closed Session

c. Reconvene to open session:

I. Possible report on action taken in Closed Session, pursuant to Government Code section 54957.1 and S.F. Administrative Code section 67.12(b).

ii. Vote whether to disclose any or all of the discussions held in Closed Session pursuant to S.F. Administrative Code section 67.12(a)

Pursuant to Government Code section 54957 and San Francisco Administrative Code Section 67.10(b) and Penal Code Section 832.7:

Adoption of written findings denying motions to dismiss disciplinary charges filed in case nos. C06-181 JCT, C06-183 JCT, C06-184 JCT, C06-185 JCT, and C06-188 JCT (ACTION ITEM)

12. Vote to elect whether to disclose any or all discussion held in closed session (San Francisco Administrative Code Section 67.12(a)) (ACTION ITEM)

13. Adjournment (ACTION ITEM)

The Commission will hear public comment on all agenda items before or during discussion of the item. The period of time allowed for public comment may be modified by the Chair in the interest of fairness to all those wishing to address the Commission.
